  • If possible, turn off all air conditioners and use them only if necessary during the packing. Furniture kept in a constantly cooled climate may condensate when exposed to hot air. Allowing your furniture to adapt to the hot air can be helpful in removing a potential moisture problem during transit.
  • Pack your suitcases and move them (with other valuables) to a safe place such as a neighbour’s home. This will prevent them from being accidently packed.
  • Put your personal telephone and address book with your carryon luggage if flying. You may want to get in touch with people quickly on arrival.

Congress Throws Life Vest To Sinking Renters!

On the phone, I encouraged Jenny, informing her of new legislation protecing tenants. Jenny hadn’t heard this. Chances are, neither have you. Let’s take a look at how Congress has been forced to stepped in to help tenants facing eviction by no fault of their own.

The new law provides a 90-day notice requirement and additional protections for tenants in foreclosed properties.

Below you will find the major provisions outlined under Title VII of the Protecting Tenants at Foreclosure Act of 2009.

  • During the term of the lease, the tenant has a right to remain in the unit and cannot be evicted, except for actions that constitute good cause.
  • If the lease ends in less than 90 days, the new owner may not evict the tenant without giving the tenant at a minimum 90 days notice.
  • However, the new owner may terminate the tenancy if the owner will occupy the unit as a primary residence, and has provided the tenant a notice to vacate at least 90 days before the effective date of such notice. This is the only exception to the rule that the tenant may not be evicted during the term of the lease.
  • These provisions expire on December 31, 2012. At the end of the term of the lease, the new owner may terminate the tenancy if the new owner provides a 90-day notice.

Sarasota foreclosure tragedies involve renters as well as homeowners, some of whom never see this tragedy coming until they arrive “home” to an eviction notice taped to their front door. Stressful Financing Situation

I’m not going to include everything that went on with the financing for this deal but will give you a good enough feel for it so that you can see what my client went through.  This is not typical for buyers in the Clearwater real estate market but it is good to be aware of what can happen so you are better prepared for any eventuality.

This client came down from Toledo to try to find the perfect home for their upcoming retirement.  We found exactly what they were looking for and they got in touch with the company that had financed 2 of their previous homes to begin the loan process.  Their finances were very solid and they had excellent credit so there would be no trouble getting a loan.

There were some issues that came up that had to be handled as we went along but nothing major, until 4 days before closing.  At that point the you-know-what started to hit the fan.  The first thing that came up was there was a mistake made in the early calculations which changed what my client would need to have for closing.

The next thing that came up was that the lender wanted to reverify my client’s employment.  The only problem with this was it was late July and she is a teacher and the schools weren’t open.  We did get that resolved but it wasn’t a welcome surprise.

What made these things a real problem was that my client had left Toledo on Monday to drive down for the closing on Friday and was part way here and had to go back home to deal with some of these issues.

Because of the last minute change in the funds my client had to bring they had to do a transfer from their retirement account.  Unfortunately this took 2-3 days which meant we could not close on time and so we had to extend the closing date.

To add insult to injury, the bank then started nit-picking on where every penny came from that was in my client’s account for their closing funds.  Even though they had many times what they needed for closing in their retirement account, the bank said those were not liquid funds and didn’t count and wanted proof of where all the money came from that was to be used for closing.

It even got to the point where they wanted proof of $1200 cash my client deposited into their account (which was money their son repaid on a loan).  For someone who had more than enough money in their various accounts and has always kept everything in relation to their finances very clean, it was frustrating to be dealt with like someone guilty who has to prove their innocence.

Just when my client was ready to give up, we finally got the news that the lender had cleared the loan to close (late Wednesday afternoon – the closing was Friday and my client had to dirve to Florida from Toledo).  They were in their car within minutes of finding out and made it down here in time.

Despite everything the lender did to almost kill the deal, we did get it to a successful closing.

In rereading this I realize it doesn’t do justice to just how stressful and frustrating it was for my client but I hope it at least gives you a sense of how ridiculous things can get.

I won’t say which lender they were using but it is one of the big ones that recently had their foreclosure filings halted due to improper paperwork.

This is why I recommend using a local bank or a mortgage lender, someone who not only keeps close track of what is happening but who can also reach someone more easily to check on progress.

I highly recommend that you take this advice to avoid having to go through this kind of stressful situation .  Let’s make sure that when you do go about buying a home, condominium or townhouse in the Dunedin FL real estate market that your experience goes a little more smoothly than this.
